Definitions

When used in this Privacy Policy, the words “we,” “us,” “our,” and “BIT” mean Blue Ink Technology, Inc. and the words “you,” “your,” or “user” mean the administrator on your account or app, the customer, the driver, the end user, or any other person that uses our products or Services or visits our web site.

The words “Personal Information,” when capitalized, shall mean your name, mailing address, email address, telephone number, birthdate, driver’s license and credit card information.

Introduction

At Blue Ink Technology, Inc. we take your privacy very seriously.

This page describes some of the ways that we collect, store, use, disclose, and manage your data including personal information. A number of examples are used on this page and these are meant to help illustrate our practices, but you should be aware that these examples are not complete or exhaustive. When we talk of our Services below we mean the Services defined in our Terms of Service document.

This Privacy Policy applies to you when you use our products and Services or you visit our web site.

How we collect your data

We acquire data from you and the devices you use when you create an account, communicate with us, use our products and Services, or access our web site. We need your data to provide you with our Services. We collect information that you upload to our Services and information that is derived from your use of our products and Services.

When you fill out fields on our web site or in our mobile apps the data that you enter is collected and sent to computers so that we can provide you various Services. We also collect data automatically to support these Services. For example, our ELD adapter automatically reads data on your vehicle's data bus. We automatically collect this data to provide you with our ELD compliance and other Services. We also use data from third-parties who might have data about you. For example, we use data from the DoT's FMCSA for the purpose of being able to match a USDOT number to a carrier.

The web servers we use also collect data about your visits to our web site. This includes information such as your IP address, browser version, the page that referred you to our web site, the time of your visit, and other information.

Our mobile apps do not collect data that they did not generate. This means we do nothing with photos, videos, or other media you may have created on your mobile device outside of our mobile app. Our ELD will capture data such as speed, location, current weight, fluid levels, and seat belt status.

Our Services are not targeted or directed towards minors. We do not intentionally collect or store information about children.

How we store your data

We store data on web servers, web browsers, mobile devices, and our products.

Our ELD adapter has internal storage that is used to record data we need to provide you with our ELD Service. Our mobile app stores data on the devices on which it is installed. When you log in to your account on our website we store a small data file called a cookie on the browser you used for your visit, which primarily is used to support authentication to your account and to allow our system to recognize that you have accessed our system. Your data is aggregated on web servers to support your use of our Services.

It is important to know that we do not own any of the physical devices used to store your data. When you purchase an ELD adapter from us you become the owner of the physical device. We do not own the devices that are running our mobile apps. We do not own the browser you use to visit our website or the computer on which the web browser is running. We use third-party providers (such as Amazon Web Services and Google Analytics) to store your data and to make our website available to you. This means that we are not in absolute control of your data, and you may need to consult the privacy policy from the manufacturer of the mobile devices you use with our Services and the privacy policy of the third-parties that we use to provide the Services (see the Links section below).

How we use your data

We use your data to provide you with our Services and to improve our Services. To accomplish this task we may transform, process, truncate, or analyze your data.

We may use your data for purposes such as:

  • Providing information about our Services and products to you.
  • Assisting us in managing your account and administering your subscriptions.
  • Verifying your identity.
  • General analytics.
  • Enforcing our Terms of Service.
  • Responding to your inquiries or comments and otherwise communicating with you.
  • Processing billing and payments.
  • Providing product and technical support.
  • Analyzing, developing, monitoring and improving the performance and security of our products and Services.
  • Notifying you of new products or Services, changes or updates to our products and Services, Privacy Policy, and Terms of Service.
  • Complying with applicable laws, rules, and regulations.
  • Using third party analytics tools, such as Google Analytics, to measure traffic and usage trends for our Services and to collect demographic data on our users.

Your data may go through multiple transformations so that we can offer you our Services. For example, to be compliant with the FMCSA's ELD mandate we must determine if your vehicle is in motion. To accomplish this we read or query your vehicle's data bus for the vehicle speed. The raw data given by the vehicle is in a binary encoding. Our ELD adapter translates this into a speed value. If a mobile device running our app is connected to the ELD adapter then this speed value is encrypted and transmitted to the mobile device. Our app then compares the speed value against the FMCSA's mandated speed that defines that the vehicle is in motion. The determination of this in motion status may trigger other events that may or may not be recorded.

In support of improving our Services we may acquire detailed data from your mobile device to support fixing a problem that is impacting our Services. This may include low level data that details what our mobile app is doing, what information it is acquiring, or how it is processing data.

Where possible, we try to protect your privacy. For example, we must acquire your location for compliance with the FMCSA's ELD mandate. Typically, we obtain your position with a great deal of resolution, often to 6 or 7 decimal places. However, for the records used for FMCSA compliance we only record your position to 1 or 2 decimal places because this is all that is required. Other Services which you may use could make use of the full resolution of the data we collect, for example if you were to subscribe to our Services to support dispatching capabilities we may display and save your position with full resolution, but these would be separate records from those used for ELD compliance, which would be of lower fidelity.

How we disclose and share your data

We share your data with others, both inside and outside of the BIT organization, when necessary or appropriate to support or improve our Services.

You may use our Services to share your data with others, such as an official performing a roadside inspection, a motor carrier company that you have a relationship with, or someone else that you designate. For example, you may use our Services to share your driving records with that person or company via email.

We may have to share your data to comply with applicable law and regulations, or to respond to lawful requests such as subpoenas, warrants, or court orders.

Data collected from users is a business asset of BIT. We may share your data in connection with, or during the negotiation of, a merger, sale of stock or assets, financing, acquisition, divestiture, or dissolution of all or part of our business.

We may share aggregate, non-identifiable information with third parties to support our Services.

We may share your data if we believe the disclosure is reasonably necessary to protect our rights or property, or the security or integrity of our Services, or to protect us, other users of our Services or the public from harm or potentially prohibited or illegal activities or violations of our Terms of Service.

We may share your data with third party service providers, such as credit card processing services, website management, customer service, analytics, etc. in order for third party service providers to perform functions on behalf of BIT. BIT engages third-party vendors to help us provide the products and Services. These third-party vendors may have access to your data to perform these tasks on our behalf.

We may share your data with third party vendors, app providers, carriers, insurers, and others that you authorize to access your data by giving them your username, password, or access key. Use of your username, password or access key by a third party is deemed to be your permission to us to disclose your data to that third party.

We may share your data to protect, establish, or exercise our legal rights and remedies or to defend against impending or asserted legal claims or a violation of our policies.

We may share your data with our affiliates, including for marketing purposes. You may opt out of receiving marketing material from us by emailing us at support@blueinktech.com.

You consent to our using your Personal Information as necessary to contact you about your account, debt collection, and to enforce our Terms of Service.

How we manage your data

We use standard technologies to protect your data. However, no method of transferring information over the Internet or storing information is completely secure. As a result, we cannot guarantee the absolute security of any information.

The data collected from your vehicle's data bus is encrypted before it is sent to a connected wireless mobile device. The communication channel between a device running our mobile app and our website is also encrypted. When you visit our website, your browser uses an encrypted link to interact with our Services.

We will keep your data for as long as is necessary, including after you have ceased doing business with us, for business purposes related to the provision of our products or Services. When your data is no longer needed to support our products and Services we will archive your data or delete it in our discretion.

We do not save your credit card number on the servers we use. To support purchases that you make, we forward the credit card information that your provide us during the checkout process to a third-party credit card processor. You may want to consult the privacy policy from the third-party credit card processor we use (see the Links section below).

Your Responsibilities

You are responsible for keeping all usernames, passwords, and access keys confidential. Any third party using your username, password or access key will be deemed to have your permission to access your data, Personal Information, and account until that permission is revoked by you by written notice to us which may be delivered to us at support@blueinktech.com.

You can choose to provide your data to a third party, such as a carrier or third party app provider. However, BIT may not have a direct relationship with the third party you choose and their processing and use of information is subject to their own privacy policies. It is your responsibility to review and understand the privacy policies of any third party before you share information with them. Our Privacy Policy does not apply to the practices of third parties who may receive data in connection with your use of our products and Services and we are not responsible for the privacy or security practices of third parties. If you choose to provide your data to a third party (“Permitted Third Party”), you are also agreeing that the Permitted Third Party may use and disclose your data to other parties selected by the Permitted Third Party, without any obligation on our part to supervise such Permitted Third Party’s use, disclosure, or sharing.

By using our products and Services, you agree to this Privacy Policy as it may be amended from time to time in the future.

Privacy Settings

You can designate your Personal Information as not subject to disclosure to third parties without your express written consent.

Complaints

If you have any complaints regarding this Privacy Policy, please contact us first at support@blueinktech.com. We will investigate and attempt to resolve complaints and disputes regarding use and disclosure of your data and Personal Information in accordance with this Privacy Policy and in accordance with applicable law. If you have an unresolved privacy or data use or disclosure concern that you believe we have not addressed appropriately, we and you agree to arbitration as set forth in our Terms of Service.

Indemnification

You agree to defend, indemnify and hold harmless us and our affiliates, officers, employees, subcontractors, and agents from and against any and all claims, demands, actions, causes of action, suits, proceedings, losses, liabilities, damages, costs and expenses (including reasonable attorneys’ fees and expenses and court costs) arising or resulting from or relating to the use or misuse of your data or Personal Information by any third party to whom you have given actual or deemed consent.

Governing Law

This Privacy Policy and any dispute arising under this Privacy Policy will be governed by West Virginia law and/or applicable federal law as applied to agreements entered into and to be performed entirely within West Virginia, without regard to is choice of law or conflicts of law principles.

Limitation on Time to Initiate a Dispute

Any action or proceeding by you relating to any dispute arising under or with respect to this Privacy Policy must commence within one year after the cause of action accrues.

Third Party Services and Links to Other Web Sites

You may be offered services, products, and promotions by third parties and not by BIT ("Third Party Services"). If you decide to use Third Party Services you will be responsible for reviewing and understanding the terms and conditions for these services. We are not responsible for the performance of any Third Party Services. The Services may contain links to third party websites. The inclusion of any website link does not imply an approval, endorsement, or recommendation by BIT. Such third party websites are not governed by this Privacy Policy. You access any such website at your own risk. We expressly disclaim any liability for these websites. When you use a link to go from the Services to a third party website, our Privacy Policy is no longer in effect. Your browsing and interaction on a third party website, including those that have a link in the Services is subject to that website's own terms, rules, and policies.

Other Provisions

In the event of a conflict between our Terms of Service and this Privacy Policy, the Terms of Service will prevail and control the subject matter of such conflict. If any provision of this Privacy Policy is invalid or unenforceable under applicable law, then it will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

Changes

We may modify our Privacy Policy from time to time by posting an updated version on our web site. The updated version will be effective at the time of posting.
